The University and the UAW recognize that during the negotiations that led to this agreement, each party had the opportunity to make proposals on any matter that is not legally prohibited in the area of collective bargaining. This Agreement sets forth the complete and complete interpretation of the parties with respect to the matters contained herein. This Agreement replaces and replaces all other prior or existing agreements or arrangements between the Parties, whether formal or informal, with respect to such matters. Except as otherwise provided in this Agreement, the University and the UAW agree and understand that each voluntarily waives their right to negotiate with respect to: Postdoctoral Fellow (21642) An appointment is made under the title of “Postdoctoral Fellow” if the Postdoctoral Fellow has received a scholarship or fellowship for postdoctoral studies from a non-academic organization and the scholarship or scholarship is either directly, or through a University account is paid. The University of Washington and UAW 4121 have agreed to a collective agreement for postdoctoral researchers at UW. Under this agreement, postdoctoral researchers have the right to attend a hearing held by a neutral and independent arbitrator to resolve disputes regarding termination of employment. Therefore, the Union and the University require the United States the Department of State to facilitate the issuance of a visitor visa for _____ (name of the postdoctoral researcher) who worked at the UW from ____ to _____ (employment data) as a postdoctoral researcher so that they could participate in the arbitration hearing on ___ (data) at the University of Washington regarding their dismissal from the university. PDAC postdoctoral members have the right to be represented by a union at investigative or pre-disciplinary meetings with the employer.

UAW Local 5810 is the union elected by a majority of Postdoctoral researchers at the University of California as collective bargaining representatives. The union acts and administers contracts with the university on wages, benefits, hours of work, rights, working conditions and employment for all postdocs. The University and the UAW agree that the choice of the University`s response to comply with this article or the details of an arbitrator`s award may be subject to the availability of funds. If the University declares that due to the unavailability of funds, it cannot make a change of employment to comply with an arbitrator`s award, the University may decide to reassign the postdoctoral researcher, move the research activity and/or limit the research and/or assignment. If the Union considers that the university`s alternative remedy violates the agreement, it may immediately apply to the arbitrator who remains competent to consider the alternative remedy. E. The planning of the professional development and career goals of the postdoctoral researcher should be described in an individual development plan in accordance with the provisions of Article 9, including, but not limited to, participation in conferences, job fairs and workshops. If funds are available for professional development activities, the University will cover the costs, including but not limited to registration fees, travel and other expenses, provided that the activities are described in an IDP and approved by the supervisor. For postdoctoral fellows (3253) and paid directives (3254) who have non-academic fund allocations, these funds may be used at the discretion of the university before university funds. No union, employer or person acting on behalf of a union may deny an employee or former employee who is or has been in the collective bargaining unit the right to be fairly represented by the union with respect to the collective bargaining rights or the rights of former employees. Article 4: PDAC Membership All postdoctoral fellows with a “postdoctoral associate” appointment pay a membership fee.

The currently approved membership fee is $28/month ($14/paycheck). For postdoctoral staff (3252) whose appointments are less than 100% of the time and who do not meet the DOL RSA threshold of $913 per week / $47,476 per year, their appointments will be converted to non-exempt bi-weekly appointments as of 11/16/20. In the future, these part-time and non-exempt postdoctoral fellows will be appointed to the new NEX Postdoctoral-Employee Fellow designation code (3255). The parties agree that, in accordance with federal and state laws, the employer may require employees entitled to overtime to accurately report time worked using either positive time or an exceptional time reporting process established by the employer. In the event that one of the parties announces the reopening of the time and work obligation provided for in Article 23, both parties agree to enter into negotiations within seven (7) days of notification.

Topics for negotiation may include, but are not limited to: overtime approval procedures and meal and break planning. As a postdoctoral fellow, you now have access to academic support for yourself (after 6 months of employment) and your spouses In addition to their associate appointment, a postdoctoral fellow will be offered a 2nd appointment as a “postdoctoral fellow” or “visiting postdoctoral fellow” depending on the external funding agreements they have received. Standard Insurance Company offers basic coverage in the event of death and dismemberment and accidental dismemberment (AD&D). Eligible employees are automatically covered by the plan paid by UC. The plan includes medical evacuation and repatriation of remains for international postdoctoral fellows. .
